These Terms of Service (“Terms”) govern your access to and use of NBW Flatsome Library, including the NBW Flatsome Library WordPress plugin, website, Library Server, Components, Kits, licenses, and related services.

By installing, accessing, purchasing, or using NBW Flatsome Library, you agree to these Terms.

1. About the Service

NBW Flatsome Library is an online design resource library designed for WordPress websites using the Flatsome theme and UX Builder.

The Service allows users to browse, preview, and insert eligible design resources into WordPress websites.

Features may include:

• Components.
• Sections.
• Website Kits.
• Resource previews.
• UX Builder integration.
• Asset importing.
• Favorites and Library management.
• FREE, PRO, and Agency access levels.
• License activation.
• License upgrades and renewals.

NBW Flatsome Library is an independent product and is not the developer or owner of WordPress, WooCommerce, Flatsome, or UX Builder.

2. Requirements

To use the full functionality of NBW Flatsome Library, you may need:

• A compatible WordPress installation.
• A compatible version of the Flatsome theme and UX Builder.
• A server environment that meets the plugin’s published requirements.
• Internet access for features that communicate with the NBW Library Server.

Compatibility with every WordPress plugin, theme customization, hosting provider, browser, or third-party service cannot be guaranteed.

3. FREE Plan

NBW Flatsome Library provides a FREE access level.

A paid license is not required to browse and use resources designated as FREE.

The FREE plan may include limitations such as:

• A maximum number of eligible resource insertions per day.
• Access only to resources designated as FREE.
• Other reasonable service limitations displayed within the plugin or on our website.

At the time these Terms were last updated, the standard FREE plan may allow up to 10 eligible resource insertions per day.

We may adjust FREE plan limits or features as the Service evolves. Material changes will be reflected in the Service or relevant product information.

4. PRO Plan

A valid PRO license provides access to features and resources designated for PRO users, subject to the applicable product terms.

A PRO license may be limited to a specified number of websites.

The applicable site limit, license duration, pricing, and included features are displayed at the time of purchase.

5. Agency Plan

A valid Agency license provides access to features and resources designated for Agency users, subject to the applicable product terms.

Agency plans are intended for users or teams that require NBW Flatsome Library across multiple authorized websites.

The applicable site limit, license duration, pricing, and included features are displayed at the time of purchase.

6. Licenses

Paid features require a valid license.

A license may contain restrictions including:

• Plan level.
• Number of activated websites.
• Expiration date.
• Usage rights.
• Other limits associated with the purchased package.

You are responsible for keeping your license key confidential.

You may not publicly share, resell, distribute, or publish a license key unless expressly permitted by us.

We may suspend or revoke licenses that are obtained fraudulently, intentionally abused, redistributed without authorization, or used in violation of these Terms.

7. License Activation

When a paid license is activated, the website may be registered with the NBW Library Server.

The number of simultaneously activated websites must not exceed the site limit associated with the license.

Where supported, websites may be deactivated to free an activation slot for another authorized website.

8. License Expiration

When a PRO or Agency license expires:

• Paid Library access may become unavailable.
• Premium Components or Kits may no longer be available for new insertions.
• License-based updates or services may no longer be available where applicable.

Content already inserted into your website is not intentionally removed solely because a license expires.

Previously imported content and assets remain part of your WordPress website unless you remove them yourself.

9. Renewals

Eligible licenses may be renewed through the renewal process provided by NBW Flatsome Library.

When a valid renewal is completed, the existing license may be extended rather than replaced with a new license.

Renewal pricing and duration are determined by the applicable offer displayed at the time of renewal.

10. Upgrades

Eligible licenses may be upgraded to a higher plan.

For example:

• FREE users may upgrade to PRO.
• PRO users may upgrade to Agency.

Where supported, an upgrade updates the existing license while preserving its associated activation information.

Downgrades through the upgrade checkout process may be restricted.

11. Purchases and Payments

Paid plans, upgrades, and renewals may be processed through WooCommerce and available payment providers.

You agree to provide accurate information when placing an order.

Prices, billing periods, taxes, promotions, and included features are displayed at the time of purchase.

An order may need to reach an eligible paid or completed status before license entitlements are issued or updated.

12. Refunds and Cancellations

Refund eligibility is subject to the refund policy presented on our website or at the time of purchase.

A refund does not necessarily cause an automatic downgrade or deletion of a license immediately.

Where a transaction is refunded, cancelled, disputed, charged back, or determined to be fraudulent, we reserve the right to review and adjust the related license or service access as appropriate.

13. Resource Usage

Subject to your applicable plan and these Terms, you may use eligible NBW Flatsome Library resources to create websites for yourself or your clients.

You may modify inserted designs to suit your projects.

Unless expressly permitted, you may not:

• Redistribute NBW Library resources as a competing template library.
• Resell individual Components or Kits as standalone downloadable resources.
• Scrape, mirror, clone, or bulk-download the Library.
• Provide unauthorized access to premium Library resources.
• Circumvent plan restrictions, quotas, or license controls.
• Use automated systems to abuse or overload the Library Server.
• Reverse engineer the Service for the purpose of creating a substantially competing resource distribution service where prohibited by applicable law.

14. Client Websites

You remain responsible for websites you build using NBW Flatsome Library.

This includes responsibility for:

• Website content.
• Legal compliance.
• Security.
• Backups.
• Third-party licenses.
• Client permissions.
• Hosting.
• Maintenance.

Use of a Component or Kit does not transfer responsibility for the resulting website to NBW Flatsome Library.

15. Images, Fonts, Icons, and Third-Party Assets

Some designs may use images, fonts, icons, libraries, or other assets provided by third parties or under separate licenses.

Where applicable, users are responsible for ensuring that their final use of third-party assets complies with the relevant license.

Demo or preview content should not automatically be assumed to grant ownership of third-party intellectual property.

16. Intellectual Property

NBW Flatsome Library and its original design resources, branding, service interface, documentation, and related materials may be protected by applicable intellectual property laws.

The WordPress plugin code may be distributed under the GNU General Public License or another GPL-compatible license as stated in the plugin package.

The GPL licensing of plugin code does not automatically grant unrestricted redistribution rights to independently licensed external service content, branding, hosted resources, or third-party assets.

17. External Library Service

The WordPress plugin communicates with the NBW Library Server to provide online Library functionality.

Internet access is therefore required for online Library features.

Temporary outages, maintenance, hosting issues, network failures, or third-party infrastructure problems may temporarily affect availability.

18. Service Changes

We may improve, modify, add, remove, or replace Service features over time.

This may include:

• Adding new Components or Kits.
• Retiring outdated resources.
• Changing Library categories.
• Improving plugin functionality.
• Adjusting FREE usage limits.
• Updating paid plan features.
• Improving security or infrastructure.

We will make reasonable efforts to avoid unnecessary disruption to paying customers.

19. Availability

We aim to maintain a reliable Service but do not guarantee uninterrupted or error-free availability.

Scheduled maintenance, emergency maintenance, internet failures, hosting problems, WordPress changes, Flatsome changes, or other circumstances may affect availability.

20. Support

Support availability may vary by plan.

Support may cover issues directly related to NBW Flatsome Library but does not necessarily include:

• General WordPress development.
• Custom website development.
• Third-party plugin troubleshooting.
• Hosting administration.
• Custom modification of individual Components or Kits.
• Issues caused by unsupported modifications.

21. Prohibited Use

You may not use the Service to:

• Attempt unauthorized access to our systems.
• Circumvent license or quota restrictions.
• Distribute malicious code.
• Abuse API endpoints.
• Intentionally overload the Service.
• Obtain premium resources without authorization.
• Share paid account or license access beyond permitted limits.
• Engage in fraudulent transactions.
• Violate applicable law.

We may restrict access where reasonably necessary to protect the Service or other users.

22. Disclaimer

NBW Flatsome Library is provided on an “as available” basis to the extent permitted by applicable law.

While we work to maintain compatibility and reliability, we cannot guarantee that every resource will work with every combination of WordPress, Flatsome, WooCommerce, plugins, custom code, browsers, hosting environments, or future software versions.

Users should maintain appropriate website backups before making significant changes.

23. Limitation of Liability

To the maximum extent permitted by applicable law, NBW Flatsome Library and its operators will not be liable for indirect, incidental, special, consequential, or similar damages arising from use of or inability to use the Service.

Nothing in these Terms excludes liability that cannot legally be excluded.

24. Termination
